By using and/or visiting the website you agree to the terms and conditions contained herein and the terms and conditions of privacy policy incorporated herein and all future amendments and modifications. Sign-in, account and password

You will receive a password and account designation upon completing the Sounday Sig-in process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Sounday of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

Privacy

Sounday shall in any case not sell, transfer or rent personal information to third parties for their marketing purposes without user’s written consent. User can access and modify the information provided and choose not to receive certain communications by signing in to your account. User, by his side, shall not sell, rent or transfer information of other users he may have known; in this case, Sounday can at its sole judgment, block or remove the user account.

Website and Service

Sounday provides its website as a service to its users (you can see Production, Distribution and Promotion Section on Site about) and join music and songs of artists via streaming. Further information about the artist will be careful shown on Site; nevertheless, they could be inaccurate, limited or not updated.

Sounday cannot grant continuous and direct access to website and service that could be conditioned by factors out of own control. Sounday shall not be responsible in such case for damages, injuries or less due to interruption of services.

Contents

Sounday abide by intellectual property rights and asks user to do the same. Artists not “Sounday label” works, contained in Site, shall not be copied, reproduced, distributed, transmitted, broadcasted, sold, licensed or otherwise exploited for any purpose whatsoever without the prior written consent of the respective owner. User affirms, represents and warrants to be the owner or to retain the rights of the content and the work. Site log in is free, but use of services is to pay in accordance to the single sections; Sounday may at its sole discretion have the right to remove or block access to any User account that is available via the Website at any time, for any reason, or for no reason at all, with or without notice in case of intellectual property laws infringement. Sounday may at its sole discretion have the right to choose the works to place on website and remove or block any User work or submission that is available via the Website at any time, for any reason, or for no reason at all, with or without notice. User shall not submit material that is obscene, illegal, unlawful, defamatory, libellous, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense It’s strictly forbidden submission of pedo-pornografic contents; such infringements will allow Sounday to remove or block the account. User under the age of 18 and or under the age of majority in the jurisdiction he resides and from which accesses the website are not permitted to use the website.

Use of Services

User shall not reproduce, copy, duplicate, sell, frame, resell and exploit for commercial purpose Site and Service or part of it, (except for “Sounday label” artist). Site’s user could copy or download on media device or print part of the Site only for personal and non commercial purpose. Every other use of Site contents in strictly forbidden. You agree that, except as otherwise expressly provided in this term of use, there shall be no third-party beneficiaries to this agreement. Sounday is not responsible for every and each damage or claim deriving from use of information, products and services shown on Site. Sounday shall not grant quality of services provided by his own partners; Sounday, acting in the music business, let users to find tools and partnership to create, produce, distribute and promote user’s works, but could not grant in any way the successful aim of works produced or promoted using the website services; Sounday shall not be liable for in case of delay during mixing or mastering of single work. Sounday chooses at its sole discretion the partners to realize service; every agreement concerning the service chosen by user will be only between user and Sounday. By reason of an act of God Sounday can change service provider giving promptly notice to the user, but the latter shall not ask in such case indemnity of sort.

Warranties

User is the solely responsible for any and all of own works. Furthermore, User affirms, represents and/or warrant that own or retain the necessary licenses, rights, consents, and permissions to use the work. Website and Services are devices to produce, distribute and promote, in every time and place, user’s own works and songs. Sounday does not permit copyright infringing activities and infringement of intellectual property rights on its Website. By accepting these conditions, user agrees to waive, and hereby do waive, any legal or equitable rights or remedies he has or may have against Sounday with respect thereto, and agree to indemnify and hold Sounday harmless to the fullest extent allowed by law regarding all matters related to the use of the website. Moreover, user agree to indemnify and hold Sounday and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content submitted, posted, transmitted, modified or otherwise make available through the website.

No agency

Sounday and user act in total autonomy and independence. No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this terms of use.

Notices

Except as explicitly stated otherwise, legal notices shall be served on Sunday national registered agent or to the email address user provide to Sounday during the registration process If the email address is invalid, Sounday may give legal notice by mail to the address provided during the registration process.

Jurisdiction – Dispute resolution

These terms of use and relationship between Sounday and User shall be governed by and ruled in accordance with the laws of Italian Republic. The sole and exclusive jurisdiction for any action arising out or related to this agreement shall be ruled by the Tribunale of Turin.
